Visa 485 & Australia PR Pathway: From International Student to Permanent Resident

The Visa 485 (Temporary Graduate Visa) is the first and most important gateway for international students who wish to stay in Australia after graduation. This temporary visa allows you to live, work, and gain valuable local experience, building a solid foundation for your future permanent residency applications.

From July 1, 2024, the Visa 485 underwent significant changes regarding its streams, duration, and eligibility criteria. Currently, the visa is divided into three main streams, depending on your education level and qualifications:

1. Post-Vocational Education Work Stream (Formerly the Graduate Work Stream)

• Duration: Up to 18 months (longer stay periods may apply to Hong Kong or British National Overseas passport holders).

• Target audience: Designed for graduates of vocational courses, Associate Degrees, Diplomas, or Trade Qualifications that are closely related to an occupation on Australia’s Skilled Occupation List.

• Requirements: You must complete a Skills Assessment for your nominated occupation before applying. The maximum eligible age at the time of application is 35 (or under 50 for Hong Kong and British National Overseas passport holders).

2. Post-Higher Education Work Stream (Formerly the Post-Study Work Stream)

• Duration:
• • Bachelor’s Degree (including Honours): Up to 2 years.
  • Master’s Degree (Coursework and Extended): Up to 2 years.
  • Master’s Degree (Research) and Doctoral Degree: Up to 3 years.
    (Note: Different stay periods may apply to Indian citizens under the AI-ECTA agreement, as well as Hong Kong and British National Overseas passport holders).
• Target audience: Designed for graduates who have completed a Bachelor’s, Master’s, or Doctoral degree in Australia.
• Requirements: A Skills Assessment is not required for this stream. The maximum eligible age at the time of application is 35 (or under 50 for Hong Kong and British National Overseas passport holders, or for those applying with a Master’s by Research or Doctoral degree).

3. Second Post-Higher Education Work Stream (Formerly the Second Post-Study Work Stream)

• Duration: Typically 1 to 2 years, depending on where you previously studied and lived.
• Target audience: Designed for holders of a Post-Higher Education Work stream (or the former Post-Study Work stream) visa who graduated from and lived in a designated regional area of Australia. This second visa encourages students to remain in these regional communities.
• Requirements: You must meet the specific residence and study criteria within the designated regional area.

Important Changes from July 1, 2024:

• Maximum age limit: Reduced from 50 to 35 years old for most streams (with exceptions for Hong Kong/BN(O) passport holders and Master’s by Research/Doctoral degree graduates).
• English language requirement: The English proficiency standard has been raised (from an overall IELTS 6.0 to 6.5, or equivalent).
• Replacement stream: This stream has been discontinued.

Popular Permanent Residency (PR) Pathways After Visa 485

Once you hold a Visa 485, you can explore the following Australian PR pathways, depending on your personal situation, occupation, and goals:

1. General Skilled Migration (Visas 189, 190, 491)

This is the most common pathway for international students with skills and qualifications that match the needs of the Australian labor market.

• Visa 189 (Skilled Independent Visa):

Target audience: For highly skilled professionals whose occupations are on Australia’s priority list. It does not require state/territory nomination or family sponsorship.

Requirement: Requires a high EOI point score.

• Visa 190 (Skilled Nominated Visa):

Target audience: For individuals nominated by an Australian state or territory government.

Requirement: You must commit to living and working in that state/territory for a specific period. The required EOI score is often lower than for the 189, and many occupations not invited under the 189 can still be nominated under the 190.

• Visa 491 (Skilled Work Regional (Provisional) Visa):

Target audience: A 5-year temporary visa requiring nomination by a state/territory government or sponsorship by an eligible relative to live and work in regional areas of Australia.

PR pathway: After holding the Visa 491 for 3 years and meeting residency and tax return criteria in a regional area, you can apply for the Visa 191 (Permanent Residence) to become a permanent resident.

• Essential Steps to Prepare:

Calculate EOI points: Based on factors such as age, English proficiency, qualifications, Australian work experience, partner points, and other criteria.

Skills assessment: A mandatory step to prove your skills and qualifications meet Australian professional standards.

Submit an invitation request: Apply to the state or federal government once you meet the required points and conditions.

2. Employer-Sponsored Pathway (Visa 482 → 186)

If you do not have enough points for skilled migration or want to increase your options while waiting for a 189/190/491 invitation, finding an employer willing to sponsor you is another practical alternative.

• Visa 482 (Temporary Skill Shortage Visa):

Target audience: A temporary work visa for skilled professionals sponsored by an Australian business to work in occupations facing labor shortages.

Requirement: Requires relevant work experience and English proficiency.

• PR Pathway (Visa 186 - Employer Nomination Scheme Visa):

After working for the same business for a certain period (usually 2-3 years) under the Visa 482 and meeting other conditions, the employer can continue to sponsor you for the Visa 186 to gain permanent residency.

3. Relocating to Regional Australia (Visa 190/491 → 191)

This is an effective strategy for those who want to take advantage of more favorable migration policies in regional areas (areas outside major cities) of Australia.

The strategy: After receiving your Visa 485, if securing PR in your current state or city proves too difficult, you can research the migration criteria of other states. If eligible, you can look for work and relocate to an area that aligns with your criteria.

Visa 491/190 nomination: Once you meet a state or territory's regional requirements, you can submit your Expression of Interest. You may then be invited to apply for either a Visa 190 or 491.

PR pathway (Visa 191): After holding a Visa 491 for at least 3 years, meeting tax reporting requirements (currently with no minimum income threshold), and living in a regional area, you can apply for the Visa 191 to achieve permanent residency.
